Dear Sir, My father has purchased a flat in Mumbai, Ghatkopar in 2004.
Builder has signed a memorandum of understanding and handover the possession of flat to our family, but before the registartion of flat was performed, builder died unexpectedly... Since then another builder took over the proprerty but he was reluctant to register the house on our name because we didn't had any solid proof... We were staying in that flat since 2004 till now but recently our secretay of the society has mingled up with the builder and had registered the property on his own name and has filled a suit against us to vacate the property...
I have to seek a lawyer, but I wanted to ask if it's worth it to appoint a lawyer and spent money? is there any chance that we can still retain this property which we are in possession since last 10 years?
I want to understand if I should compromise with the Secretary or should i fight the case in court? Pleaseeee advice....
