Fraud by Builders in the name of Maintenance Agency

Once again the builders in Greater Faridabad are upto it!!

Puri has allegedly floated a shadow company M/s Full Mark Facilities Management Private Limited Ltd which is controlled by Puri Construction, for the maintenance Services of Pranayam

The second instance is that of RPS which has created "Claire Heights Estate Services Private Limited", Allegedly to shortchange innocent buyers, planning to move into towers earlier offered for possession.

Both these shadow companies are created by builders and subcontracted maintenance to Jones Lang La Salle.

In both the cases the Artificial company so created by builders is owned, managed and manipulated by the builders.

The biggest loss is to the buyers who will have to pay margins both to JLL and the dodgey maintenance companies promoted by the builder.

Technically, builder has nothing to do with maintenance once an RWA is formed. The builder is supposed to have a deed of declaration conveyed to the RWA, handing over the common areas and maintenance to the RWA, under the HAO Act. as well as HDR Act.

They have no business over the common areas or the maintenance.

Further, as per Order of MoF, NO SERVICE TAX IS APPLICABLE ON MAINTENANCE CHARGED BY RWA.

However, if the private service provider is engaged a huge amount goes as service tax out of the pockets of the home owners. Let us assume Rs 4 psf per month paid on 1500 sq ft or 72000 pa will attract appx Rs 9000 pa from every home buyer, at the current rates!!!..

Only if all Home buyers contribute Rs 10000 per unit, to the RWA, a good lawyer can be hired to rout out the strangle hold of builder from such extortionist practices.

It is high time that respective RWAs be formed and the builders be asked as to the propriety of this act, which is clearly against the interest of the stakeholders ie home seekers.

Add to this huge amount being charged as INTEREST FREE MAINTENANCE DEPOSIT held by the builder, FREE OF COST and with no transparency of accounts!!

Infect BPTP had in its BBA mentioned the IFMS as Interest Bearing, but now is refusing any such interest to plot owners.
