I purchased flat in Navi mumbai (It is under CIDCO). I got OC 3 months back. I have taken possession.
My flat is 1 BHK with terrace. ( my terrace is duplex (having double height)) because on my top there is 1 bhk flat. So my terrace is double. Bottom to my flat is 2 bhk.........so combination is 2bhk-1.5bh then 1bhk and so on.
My doubt is now i want to start construction in this terrace portion. I want to cover my terrace. I am considering 3 options
1) I will cover below portion of terrace with shades and convert my 1.5 bhk to 2 bhk. So that will no problem for anybody in society, because i own that balcony.
2) If i cover below portion of terrace with T angels (as builder had already given beams...so i want to construct slab and side walls) and add ladder so we can use top space also. So it will be 2 bhk and big terrace.
3) I will cover terrace in lower and upper portion so it becomes 3 bhk.
Our building is in Builders hand (for 1 year) then society will form.
At present in my building 2 people convert there 1.5 bhk to 3 bhk. I am also interested in doing same but worried as top floor 1 bhk makes issue of this (not a single part of his flat coming to that portion of terrace such as window etc. It is completely isolated from 1 bhk)
Builder also visited last week to one of the 1.5 bhk converted to 3 bhk flat.
I want to know about any legal issues aries in later phase?
1) If i convert to 3 bhk..... CIDCO will take action?
2) If i increase my area by one terrace (using top portion terrace) then i can do it in legal way? by giving some money to CIDCO or any other firm?
3) If i convert to 3 bhk and then if my top floor 1 bhk claims for that then??
Actually i am totally confused. I want to do it but with less problems..........because i will spend good money for this and then having fear in my mind...or like seating on fire.........please respond to my query.....If u come across any issue like this please share me........Kindly guide me.......
