I have booked flat and already due for payment.
Subsequent to the legal opinion, it was observed that one of the party to the Power of Attorney not included as the confirming party in the Agreement to Sale.
Thereafter followup was done with the builder, it was agreed that Rectification Deed shall be registered to rectify the mistake.
The process for loan sanction and disbursement shall take another 15-20 days. so I shall able to make the payment only on 10th August 2013.
Now as per the agreement the payment was due on 13th June 2013.
As per the clause of agreement the builder may demand interest for late payment.
As the delay was only because of incorrect documentation by the builder, how the builder has to be cornered for the same.
Whether I should wait to receive a demand letter for interest payment..
